This agreement is made between the person paying the applicable subscription fee ("the
Customer") and Camden Council ("the Council"), and sets out the terms and conditions under
which the Customer may use the Council's Garden Waste Collection Service (“the Service”).
1. The Service is available to the Customer, on payment to the Council of the applicable
subscription fee, for:
a) A period of 12 months from 1st April – 31st March. Subject to the terms of this agreement,
the Service shall be provided on a weekly basis.
b) A period of 9 months from 1st April – 30th November (inclusive) + the month of March
next year. Subject to the terms of this agreement, the Service shall be provided on a weekly
basis.
2. Customers who are new participants in the Service shall have a service commencement
date no later than 10 working days from the date of notification,
3. The Customer may use the Service for the collection of all items of garden waste as
specified on the Council’s website. The Customer may not use the Service for the collection
of any other waste.
4. If any other waste is presented for collection it shall not be collected, and the Council may
consider this agreement to be immediately terminated.
5. In using the Service, the Customer may only use the designated garden waste container
(“the Container”) provided by the Council. The Council shall not collect garden waste
contained in any other container. The Container shall remain the property of the Council at all
times.
6. The Container shall be either 1 x 240 litre brown wheeled bin or 3 x 80 litre reusable
branded hessian bags. Any additional Containers shall require an additional subscription.
7. Garden waste must be presented within 1 metre of the front boundary of your property by
7am on the scheduled day of collection, and must be accessible and clearly visible to the
collection crew. The crew shall not return to collect waste that is not at the agreed collection
point by 7am. Containers shall be returned to the same location by the crew.
8. In the event that correctly presented garden waste is not collected on the normal collection
day, it is the Customer’s responsibility to report this within two working days after your
collection day.
9. The lids of brown wheelie bins containing garden waste must be fully closed. The Council
reserves the right not to empty any wheelie bins where the lids are not fully closed as this
may cause damage to the lids whilst being mechanically emptied.
10. The Council reserves the right not to empty or collect any Container that in its reasonable
opinion poses a health and safety risk to operatives or exceeds a weight of 50kgs, and may
require the Customer to reduce the weight in the Container or otherwise reduce the risk to
operatives before any further attempt to empty or collect the Container is undertaken.
11. The Service may be limited over the Christmas and New Year period. The Service shall
also not be provided in the event that the Council is unable to provide it due to circumstances
beyond its control or other force majeure events.
12. Prior to the end of the fixed term of this agreement, the Council shall send to the
Customer an invitation to renew their entitlement to the Service for either the following 9
month or 12 month period. The subscription can be renewed using any of the available
subscription methods, with full payment in order for the Service to continue for the next 9-12
months. If a Customer applies for the Service at any point throughout the year, a pro-rata rate
shall apply. This agreement shall continue until the end of the financial year on 31st March.
13. If full payment is not received prior to the expiration of the current agreement, the
Council shall assume that the Customer no longer requires the Service and may therefore
collect the Container from the Customer’s property within 14 days of the date of expiry of the
agreement. If the Container is deemed by Council staff not to be accessible, the Customer
shall be invoiced for the full cost of a replacement Container and any associated costs of the
aborted collection. Such costs shall be payable by the Customer to the Council on demand
and shall be recoverable by the Council as a debt.
14. Where the Council has ceased provision of the Service to any Customer as a result of any
non-payment of a relevant Service subscription, the Customer may apply to restart the
Service (subject always to the Council’s discretion) but the contract shall be backdated to the
date on which the contract originally expired, unless 12 months has elapsed since the expiry
date. Where 12 months or more has elapsed a new contract shall be generated.
15. The Council shall review its Service charges on an annual basis, effective from 1st April
each year, but reserves the right to vary charges, with reasonable notice, at any time.
16. For the duration of this agreement, the Customer shall be responsible for the Container
provided, its cleanliness and the cleanliness of the site around the Container.
17. The Customer shall keep the Container safe and secure at all times. In the event of the
Container being lost, stolen or damaged, the Customer may be required to pay to the Council
the costs of an equivalent replacement Container and its delivery. Such costs shall be payable
by the Customer to the Council on demand and shall be recoverable by the Council as a debt.
The Council shall carry out routine repairs to any Containers where the Council reasonably
considers this to be necessary due to normal wear and tear.
18. Where a Customer plans to move property during the term of this agreement, the
Customer shall so inform the Council. If requested, the Council shall continue to provide the
Service to the Customer’s new property, provided that this is located within the borough
boundary. Where participation in the Service is to be discontinued, the Customer must so
inform the Council by giving 4 working weeks’ notice in order that the Container may be
collected from the Customer’s current property.
19. On termination of the Customer’s entitlement to the Service (however such termination
occurred), the Council reserves the right to enter the Customer’s property to recover the
Container.
20. Once a Customer has subscribed to the Service, they shall have 14 days in which to
decide whether to leave and cancel their subscription. The Customer shall be entitled to a full
refund within the 14 days. After the 14 day period has expired, no refunds shall be offered.
21. This agreement includes the Duty of Care for the weekly removal of garden waste in
accordance with Section 34 of the Environmental Protection Act 1990.
